Actor Faces Strong Arm Robbery Charges Under Florida Criminal Laws after Allegedly Attempting to Steal Wife’s Cell Phone – What is “Strong Arm Robbery” in Miami?

ArrestedBars

An actor from Cuba residing in Miami faces criminal charges under Florida laws, and some members of the Miami-Dade community are wondering exactly what the charges against him mean. According to local news reports, the 44-year-old actor and Miami father, who starred in a number of well-known telenovela roles, was arrested on Wednesday, May 14 at the home that he shares with his family, located in the 3800 block of 150th Court, in

Miami. Reports indicate that the man has been married to his wife for 17 years. The couple has three children born of the marriage, and they are currently in the midst of a pending divorce. The couple allegedly began arguing at some point in the evening on that Wednesday, and just before 11:30 p.m. in the evening, the incident that led to the actor’s arrest allegedly occurred. The couple is believed to have been arguing about “marital issues,” and the man is believed to have taken his wife’s cell phone and was “snooping through it.” A struggle over the cell phone then allegedly ensued, and investigators believe that the man took the cell phone from his wife forcibly. The phone is valued at $250. Officers arrived at the couple’s home, and arrested the man for the forcible taking of the cell phone. He was ultimately charged with second-degree strong arm robbery. The case is ongoing, and it remains to be seen what will happen in the case, or if there will be criminal conviction.

The Offense of Strong Arm Robbery Under Florida Laws

In light of the recent arrest of the well-known telenovela actor in Miami, it is important for individuals in Miami to understand the offense of strong arm robbery under Florida laws. Under Florida laws, “‘Robbery’ means the taking of money or other property which may be the subject of larceny from the person or custody of another, with intent to either permanently or temporarily deprive the person or the owner of the money or other property, when in the course of the taking there is the use of force, violence, assault, or putting in fear.” This is also called “strong arm robbery”: the intentional and unlawful taking of money or property from another person through the use of force or violence against that person. Importantly, if the alleged offender used a “firearm or other deadly weapon” in the course of committing the alleged robbery, the charge is classified as a first-degree felony. The offense of robbery is classified as a second-degree felony if no firearm or other deadly weapon was used.
