Arson Charges Dropped Against Miami Man Suspected of Igniting “Historic” Apartment Fire

One thing that those who have been charged with serious crimes in Miami should know is that in some cases, often with the help of a good Miami criminal lawyer, these serious charges may be dropped. Indeed, while it may be incredibly shocking, heartbreaking, frightening, and confusing to be hit with criminal charges in Miami, the truth of the matter is that the prosecution must still prove the crime, and the case may shake out so that those charged are ultimately let go without a criminal record. A recent case involving a Miami man who was suspected of starting an apartment fire described as “historic” demonstrates just this, and encourages individuals in Miami who have been charged under Florida criminal laws to get legal help immediately to fight the charges against them.
According to local news reports, earlier this year in the summer, 73-year-old Juan Francisco Figueroa was hit with criminal charges, including arson in the first degree and using a gun while committing a felony. Figueroa was charged with these crimes after a massive fire was set to an apartment building, and a man, 30-year-old Feder Biotte, who had been shot with a firearm was also found at the scene. The fire occurred at the Temple Court Apartments in Miami, and it is reportedly the worst fire that Miami first responders had experienced in the last 25 years. The fire to the Temple Court Apartments also displaced a whopping 40 people.
Although Figueroa was suspected to be both the arsonist that set the apartments ablaze, and the perpetrator of the gunshot wound to the man who was found at the scene, Miami-Dade State Attorneys dropped Figueroa’s arson in the first-degree charge. Prosecutors said of their decision to drop the arson charge against Figueroa, “There was insufficient evidence to meet the statutory requirements necessary to charge arson…However, that matter is still being investigated and if sufficient further evidence can be developed, the charge can be and would be refiled.” They also added, “arson was dropped, but it has not been forgotten.” At the time of these statements police were still unable to confirm the cause of the massive and historic apartment building fire. As for Figueroa, he pleaded not guilty to the remaining charges against him, including possessing a firearm as a convicted felon, and charges related to the attempted killing of Biotte on the day of the Temple Court Apartments fire.
