Miami Man’s Attempted Murder Charges for Allegedly Attempting to Kill Father on Father’s Day Evening Highlights Nuances Between Murder, Domestic Violence Charges Under Florida Laws

Jailed

Father’s Day is a day intended to celebrate the beloved fathers that we have in our lives, whether they are our brothers, step-fathers, grandfathers, our own husbands, or our own fathers. Indeed, Father’s Day is typically a day for barbeques, drinks, games, and just downright enjoying being with one’s family, and the patriarch of the house. However, for some Miami families, Father’s Day 2025 was more of a nightmare than a celebration. The alleged attempted murder of one Miami man on the evening before Father’s Day demonstrates this.

According to local news reports, in the late evening of Saturday, June 14, just ahead of Father’s Day 2025, a 25-year-old Miami man allegedly attempted to shoot and kill his father with a firearm. Reports indicate that the incident happened in Miami at Northwest Fourth Street and 48th Court in the Flagami neighborhood. Miami Police officers responded to the incident and were given conflicting information from witnesses who were at the scene of the alleged crime. At the end of the day, however, neighbors said that “at least two gunshots were heard at the home where [the man] lives with his parents.” Detectives were able to “sort out” what they believe actually happened in the home, and the 25-year-old man was ultimately arrested on Sunday, Father’s Day. He was charged with a felony charge of attempted murder with a deadly weapon. The man’s father, the alleged victim, was transported to the hospital following the alleged shooting. The case remains ongoing.

Attempted Murder of Family Members Under Florida Criminal Laws

One of the questions that individuals in Miami may have about the recent case in which the 25-year-old Miami man allegedly attempted to kill his father on Father’s Day eve is why the suspect was not charged with domestic violence crimes, even though he allegedly attempted to kill a family member. The nuance under Florida criminal laws is, indeed, interesting. One of the reasons that the 25-year-old man may have been charged with attempted murder, rather than for domestic violence crimes, is that attempted murder is a more severe charge for the act that was allegedly committed. On the other hand, domestic violence is not a standalone charge of its own, but is rather a context for which other crimes are committed. As such, a person may be charged with a “primary” or “core” charge of attempted murder, and the aspect that the crime may have also been in the context of Florida’s domestic violence laws may be used to apply special conditions or enhanced sentencing to the underlying charge.

There is no doubt that understanding the charges that one is facing can be complex and challenging in Miami criminal cases.
